Form 14A Affidavit (General) - Ontario, Canada

Form 14A, Affidavit , is a formal document used by Ontario residents to make an official statement regarding an ongoing family case or react to an existing order or decision. People who take part in the proceedings can express their opinion about the case if they directly participate in it or have evidence that may affect the case - for instance, they are relatives, friends, or neighbors of the applicant or respondent who have information that influences the outcome of the trial.

Form 14A Instructions

Follow these steps to prepare Form 14A:

  1. Indicate the number of the court case. Select the name of the court - if you are filling out the document online, click on the arrow to see the available options - and write down the court address.
  2. State the full legal names, addresses, telephone numbers, and e-mail addresses of the main trial participants - the applicants, respondents, and their lawyers. Enter your full name and address. Certify the facts you are about to disclose are true.
  3. Share your story in the available free space. You have almost two pages to list the statements you want the court to consider. Remember you have to be truthful, polite, and concise - record the facts you want to make known in paragraphs. Number these paragraphs if you can. The best way to draft the affidavit is to compose several paragraphs with each of them containing a separate fact you are elaborating on. Note that if you are sharing someone else's observations or remarks, you have to provide this individual's name and add that you believe their statement to be correct.
  4. If you do not use the entire space of the document for your statements, draw a line through the remaining blank space.
  5. Sign the document before a commissioner for taking affidavits, notary public, justice of the peace, or lawyer. They will witness you making your statements in writing, record when and where you composed the affidavit, and sign their own name.
